Helpful Information About Au Pairs and Taxes

This information is found on the InfoSource (During Your Year) section of your host family online account. 

While Cultural Care is not able to provide specific tax information for host families because their circumstances are so different, we are pleased to provide general guidelines regarding host family and au pair taxes, as well as information to help au pairs complete their tax returns.  Because we update these guidelines on a regular basis, we suggest that you download our most current guide to host family and au pair taxes Host Family and Au Pair Tax Information. You can also call our office and request a copy by email.

Please note that Cultural Care is not licensed to provide official tax advice, so none of our staff may counsel host families or au pairs regarding tax issues.  Since tax laws vary from state to state and are changed on a frequent basis, we advise host families and au pairs to speak with a local professional tax advisor or directly with the Internal Revenue Service for definitive answers to any specific questions regarding taxation.

Important Au Pair Tax Information

  • The IRS considers au pairs to be “employees” of the host family for tax reasons, even though they are in the United States on a “cultural exchange” visa.  This means that au pairs are required to file U.S. individual income tax returns even though many au pairs will not owe any taxes
  • By April 15, the au pair should file form 1040NR-EZ or 1040NR to report his or her au pair stipend for the previous calendar year
  • In order to file income taxes in the United States, all au pairs need to have either a social security number or an Individual Taxpayer Identification Number (”ITIM”)
  • Au pairs are allowed to claim a personal exemption for themselves, but are not eligible for the standard deduction in their tax filing.   As stated above, au pairs are not considered “students” by the IRS so they are also not eligible to exclude au pair wages from gross income under the student article of any U.S. income tax treaty
  • Because the maximum tax burden for the vast majority of au pairs is less than $1,000, there is usually no need for the au pair to make quarterly estimated payments, or to have the host family withhold taxes.  There are some exceptions to this rule which are explained in our more detailed guide which is downloadable above.

Important Host Family Tax Information

  • Child and Dependent Care Tax Credit: As long as you have used the au pair’s child care services in order to work or look for employment, the stipend paid to your au pair, the costs of room and board and the program fees paid to Cultural Care are all eligible under the Child and Dependent Care Tax Credit.  Cultural Care’s federal tax ID number is 20-2020345
  • Dependent Care Reimbursement Programs: The eligibility requirements for these programs (often called “Flex-Spending Accounts” or “FSAs”) are usually identical to those for the Child and Dependent Care Tax Credit.  Please note that expense paid for using Dependent Care Reimbursement Program funds are not also eligible for the Child and Dependent Care Tax Credit
  • Flex-Spending Account Paperwork: Cultural Care is happy to provide host families with a summary statement of payments received during a tax year.  We are also able to sign and complete most forms that your plan might require for reimbursement.  Please note, however, that we are only able to provide you either the total amount you paid in a given calendar year, or the amount you paid in a given calendar year with the dates of the applicable full au pair term of service (e.g. one year, six months, etc.).  Cultural Care cannot provide documentation explicitly pro-rating payments received to a specified range of dates.  Contact our office if you require any assistance in claiming a Dependent Care reimbursement
  • Withholding for Au Pair Taxes: Because the maximum tax burden for the vast majority of au pairs is less than $1,000, there is no need for the au pair to make quarterly estimated payments.  In addition, because au pair wages are deemed by the IRS to be paid for domestic service in a private home, they are not subject to mandatory income tax withholding on Forms 941 and W-2 by the host family. Host families usually do not need to pay federal unemployment taxes for their au pair or to withhold Social Security and Medicare taxes.  There are some rare cases where this rule might not apply - please refer to our downloadable guide for more details

Happy Thanksgiving From My Family To Yours!

Happy Thanksgiving!

To My Families….I wish you the best as you celebrate with family and friends this year!  It a busy and wonderful time…with the opportunity to encourage your au pair be part of your family by including them in food preparation, meals, the parade, and other family traditions…..I am sure they will love the day after - shopping experience:)

To my Au Pairs….dig in, be part of, help out, and enjoy our day of giving thanks!  It only comes once a year and it is a big family gathering holiday with lots of food.  Hope you enjoy it all:)  Have fun & don’t eat to much, lol!

Thank you ALL for taking care of my au pairs, my families…and for sharing, caring, and being part of my life.  I am blessed and grateful to have you in my group.

New Health Insurance Rules for Au Pairs

At the end of each au pair’s program term there is a 30-day grace period often referred to as the “additional month”. Many au pairs use this grace period as a means of traveling in the U.S. before returning home. During this time, an au pair is not covered by the health insurance she/he benefits from during her/his program term. To ensure that all au pairs are covered by insurance throughout his/her stay in the U.S., Cultural Care will now require all au pairs choosing to stay for any portion of his/her 30-day grace period to have proper insurance coverage during this time in order to book a return flight through Cultural Care.

 Any au pair who arrived to the U.S. on January 1, 2011 or later, or whose extension term ends on January 1, 2012 or later, will be subject to this new requirement. This requirement protects au pairs from potentially incurring the full cost of expensive medical treatment in the event of an accident or illness.

Au pairs choosing to stay in the U.S. through their grace period have two options for insurance coverage:

They may extend their current coverage by purchasing the “Additional Month Insurance” available through their online account in the Au Pair Store for $125 or $150 if they choose to include a sports supplement. This insurance must be purchased on or before their legal departure date.

Au pairs may also provide proof of their own insurance policy that would cover them through their grace period. This coverage must match the minimum coverage requirements, determined by the Department of State. For more information regarding coverage requirements, please refer to the insurance page of the au pair online account.

 If an au pair is not staying through his/her grace period:

She/he does not need to provide proof of insurance before requesting a return flight, however she/he must request to fly home directly after the last legal working day.

Please note that in some cases, Cultural Care may need to book the return flight on a date several days into the additional month based on flight availability. Should this occur, the au pair will not need to purchase Additional Month Insurance and Cultural Care will provide interim insurance coverage until the arranged departure date.

Washington DC Au Pair Weekend Courses

Quick Facts on the upcoming Au Pair Weekend Classes in Washington DC:

3. Registration deadline next Friday, September 23 (Late registration will be available from September 24-October 8 with a $50 late fee if spaces are still available)

4. There is a second weekend course offered during fall 2011 on December 9-11. Students can register for one weekend for $295, or both weekends (to complete the equivalent of six credits) for $500. For student wanting to register for December 9-11 ONLY, the registration deadline for that particular weekend is November 18.

Memorial Day Holiday Weekend!

We wanted to wish you all a Happy & Safe Memorial Day Holiday Weekend! 

Memorial Day office hours:

We will be closed Saturday through Monday for the Memorial Day holiday weekend. We will resume normal business hours on Tuesday, May, 31st.

 

New Extension Fee’s take effect Monday June 6, 2011:

Please note that effective June 6, 2011, the extension fee will increase to $283.  Any au pair completing his/her application on or after June 6th will be subject to new pricing….so if you are thinking about it or have started, please get it in before the cost goes up!

Taxes, deadlines, and au pairs!

Just a reminder……

As we’ve discussed many times, au pairs are required to file taxes regardless of how long you have been in the country.  Taxes must be post marked by no later than April 18, 2011 (extended this year?!).  Please be sure to submit your taxes on time!  You do not want to jeapordize your standing in the USA if you want to return someday.

The forms we reviewed at the March meeting can be found on your Cultural Care account.  You can also find 1040EZ forms online, at the library, and at some post offices.  Once completed, ask your host family to take a quick look at them for you.  Remember to sign them AND if you owe money, send a check with your taxes!

Tax day is Monday April 18, 2011……its usually the 15th!

National Cherry Blossom Festival 2011 - DC

Celebrate at the National Cherry Blossom Festival from March 26 - April 10, 2011 in Washington, DC.  Peak Blooms are said to be 3/29- 4/3.  There are plenty of events and activities you can get involved in during this time as well.  The parade will be on Saturday April 9, 2011 from 10am-Noon and is Free!
